Dissolving a Joint Estate — Ways to Partition an Inheritance
A joint estate among heirs is not a permanent arrangement (§ 2042 para. 1 BGB). Three routes lead to dissolution: consensual partition with a partition agreement (readiness for partition under § 2047 BGB, notarial certification for real estate under § 311b BGB), individual withdrawal against compensation (§§ 1935, 2094, 2095 BGB) and judicial partition — forced auction (§§ 180–185 ZVG) or partition action. Alternative: sale of an inheritance share under § 2033 BGB with co-heirs' right of pre-emption (§ 2034 BGB). Where heirs are based in France, particular questions of international jurisdiction and applicable law arise.
