Forced Share After Disinheritance — What You Need to Know
The German forced share (Pflichtteil) is a statutory minimum entitlement of close relatives to a share of the estate. It amounts to half of the statutory inheritance share and is directed against the heirs. Entitled are children, spouse/registered partner, and parents where no children survive. The claim expires three years after the entitled person learned of the death and disinheritance. For entrepreneurial families, the forced share represents a structural risk that can be reduced through early structuring.
