Franco-German Inheritance — Which Law Applies?
Since 2015 the EU Succession Regulation (No 650/2012) determines the applicable law in Franco-German estates: in principle the law of the deceased's last habitual residence. Article 22 allows a choice of the law of nationality. The German forced share (§§ 2303 ff. BGB) and the French réserve héréditaire are structurally different. Particular care is required for real estate and business assets with connections to both countries.
